1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and MMC Media LLC, doing business as OwnerBuildHQ ("OwnerBuildHQ," "we," "our," or "us"), governing your access to and use of ownerbuildhq.com and the OwnerBuildHQ web application (collectively, the "Service").

By creating an account, clicking "Get Started," or otherwise accessing or using the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree to these Terms, do not use the Service.

2. Service Description

OwnerBuildHQ is a construction project management application designed for owner-builders — individuals who are building or managing their own home construction project. The Service provides tools for task management, budget tracking, daily logging, contractor coordination, document storage, permit tracking, calendar scheduling, and related project management features.

OwnerBuildHQ is a project management tool only. We do not provide construction advice, engineering services, architectural services, legal advice, or financial advice. Always consult licensed professionals for matters related to your construction project.

3. Account Registration

To use OwnerBuildHQ, you must create an account. By creating an account, you agree to:

• Provide accurate, complete, and current account information (name and email address).
• Maintain the security of your account credentials. You are responsible for all activity that occurs under your account.
• Notify us immediately at support@ownerbuildhq.com if you suspect unauthorized access to your account.
• Not share your account with others. Each account is for use by a single individual.

We reserve the right to suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.

4. Subscription, Billing, and Free Trial

Free Trial

New users receive a 14-day free trial with full access to all features. No credit card is required to start your trial. At the end of the 14-day trial period, you will need to subscribe to continue using the Service. If you do not subscribe, your access to certain features will be limited.

Subscription Plans

• Monthly Plan: $39.99 per month, billed monthly.
• Annual Plan: $299.00 per year (~$24.99/month), billed annually.

Prices are in U.S. dollars and subject to applicable taxes. We reserve the right to change pricing with 30 days' notice. Price changes will not affect your current billing period.

Automatic Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually). By subscribing, you authorize us to charge your payment method on a recurring basis. You can cancel auto-renewal at any time in Settings → Subscription.

Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current paid billing period — you will retain access to the Service through the end of the period for which you have already paid. We do not prorate partial-month cancellations for monthly plans.

Refund Policy

If you are dissatisfied with the Service within the first 7 days of your initial paid subscription, contact us at support@ownerbuildhq.com and we will issue a prorated refund for the unused portion of that initial billing period. After 7 days from your initial payment, all charges are non-refundable except where required by applicable law. Annual plan payments are not refundable after 7 days from the date of purchase.

5. Acceptable Use

You agree to use OwnerBuildHQ only for lawful purposes and in a manner consistent with these Terms. You agree NOT to:

• Use the Service for any illegal purpose or in violation of any federal, state, or local laws or regulations.
• Attempt to access, scrape, or crawl the Service using automated tools, bots, or scripts not expressly authorized by us.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service.
• Upload or transmit viruses, malware, or any other malicious code.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Resell, sublicense, or commercially exploit any portion of the Service without our express written permission.
• Use the Service to store or transmit material that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate your account immediately if we determine, in our sole discretion, that you have violated these acceptable use restrictions.

6. Intellectual Property

Your Content

You own all data, content, and files you create or upload through OwnerBuildHQ ("Your Content"). We claim no ownership over your project data, documents, photos, or any other content you create. By using the Service, you grant us a limited, non-exclusive license to store, process, and display Your Content solely as necessary to provide the Service to you.

Our Intellectual Property

The OwnerBuildHQ software, user interface, branding, logos, and all related intellectual property are owned by MMC Media LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works of the Service or its content without our express written permission.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THAT ANY INFORMATION PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, OR RELIABLE.

OwnerBuildHQ is a project management tool only. We make no representations about the suitability of any construction methods, estimates, or plans you may create using the Service. All construction decisions remain solely your responsibility.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MMC MEDIA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.

9. Indemnification

You agree to defend, indemnify, and hold harmless MMC Media LLC and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

10. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Service ceases immediately. If you wish to terminate your own account, you may do so in Settings → Account → Delete Account. Provisions of these Terms that by their nature should survive termination shall survive, including Sections 6, 7, 8, 9, and 11.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Utah, and you consent to personal jurisdiction in such courts.

12. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by displaying a prominent notice in the app at least 14 days before the changes take effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes.
